"Trade" (as defined by Trades Licensing Act No. 455/1991) is an continuous activity carried out independently, on one‘s own behalf, under one‘s own responsibility, with the aim to obtain profits. This activity must be carried out under the conditions stipulated by the Trade Licesning Act. There are numerous fields of activity that are not considered to be trades; among others: profession of doctors, dentists, notary public, lawyers, research activities, education in schools.
Businesses are divided into different groups according to the legal requirements imposed on their performance. There are two main types of trades: those that are subject to registration and those that are regulated - concessions. The first group includes „crafts“ (watchmaking, bricklaying, hairdressing), „licensed trades“ (eye optics, design activities under construction, driving school) and „free trades“ (liquor production, accommodation services). Trade permission is granted to applicants who fulfill statutory conditions and pay administrative fee. They do not have to wait for the Trade Office to issue authorization; the right to practice the trade they have chosen arises as soon as they fulfill the conditions.
Conversely, concession applicants need to wait for the authorization to be issued by the State. Licensed trades include activities subject to heavy sectoral regulation in order to maintain safety and certain standards. These include, for example, conducting pyrotechnic trials, running a travel agency, operation of a rifle-range, operation of a crematorium.The application for a concession must be accompanied by appropriate certificate of professional competence and, if required, by other documents. Additionally, favourable opinion must be expressed by state authorities.
