Liability for VAT of entrepreneurs (legal or natural persons) may be compulsory or voluntary.
Compulsory VAT payer
In general, entrepreneurs are liable for VAT (according to Act No. 235/2004 Coll., on Value Added Tax) if they are domiciled in the Czech Republic and their turnover in the 12 consecutive calendar months exceeds CZK 1,000,000. There are certain exceptions as further stated by the law. The entrepreneur becomes liable since the second month (since the month following the one in which the CZK 1,000,000 turnover was exceeded).
In addition, a person with an office registered in the Czech Republic becomes a VAT payer once they claim VAT return for a transaction they carried out; they become VAT payer since they day after notification of registration by tax authorities.
The VAT Act mentioned above includes further cases in which entrepreneurs are liable for VAT.
The tax period for VAT payers with a year turnover up to CZK 2,000,000 is calendar quarter. Payers with a turnover of between CZK 2 and 10 million choose either tax period of calendar quarter or month. VAT payers with a turnover larger than CZK 10,000,000 pay VAT monthly.
Voluntary VAT payment
However, even if entrepreneurs do not reach CZK 1,000,000 turnover, it may be an advantage to become a VAT payer. That is, for example, if they are customers (they purchase goods from suppliers). Since the supplier is a VAT payer, there is VAT added to the price they are charged for the goods. The entrepreneur have to pay VAT and the supplier would pay it to the state. Then, if the entrepreneur was also a VAT payer, they could receive the VAT back from the tax authorities (and thus reducing their expenses).
Voluntary VAT registration is always carefully considered, taking into account the specifics of the supplier/purchaser structure and other circumstances.
